The Supreme Court of India has delivered a significant ruling stating that income alone cannot be the only factor used to determine whether a person falls under the ‘creamy layer’ in the Other Backward Classes (OBC) category. The court emphasized that assessing the creamy layer requires a broader evaluation of social, educational, and economic conditions rather than relying solely on financial income. According to the bench, using income as the sole benchmark for determining reservation eligibility is legally unsustainable and may prevent genuinely disadvantaged communities from receiving benefits.
The judgment reinforces the constitutional principle that reservation policies are meant to support socially and educationally backward groups. The “creamy layer” concept was originally developed to exclude the more advanced members of OBC communities so that reservation benefits reach those who truly need them. Legal experts believe the ruling could influence future policies related to OBC reservations and the criteria used by governments when issuing non-creamy layer certificates for education and public sector employment.
